The agreement between Actualogic and the business using it. Written to be read, not to be survived.

These terms are between Actualogic ("we", "us"), a business operating in South Africa, and the organisation that opens an account ("you"). The person who accepts these terms confirms they are authorised to do so on that organisation's behalf.
A licence to use Actualogic — the web dashboard and the mobile apps — to run your own operation, for as long as your account is in good standing. The licence is not exclusive and cannot be transferred to another business.
Everything you put into Actualogic — staff records, jobs, photos, stock, financial records — remains yours. We hold and process it to run the service for you, on your instruction, as described in our privacy policy. We do not sell it and we do not use it to train models.
You may export or request a copy of your data at any time while your account is active.
The mobile apps are free to install. Paid subscriptions are arranged through this website. Subscription fees, billing period, and what happens on non-payment are set out in the plan you sign up for and in any written quotation we give you. Prices exclude VAT unless stated otherwise.
Fees are payable in advance and are non-refundable for a period already served, except where the law says otherwise or where we have failed to provide the service.
You may stop using Actualogic and close your account at any time. We may suspend or close an account that goes unpaid, or that is being used in breach of section 5, after telling you why and giving you a reasonable chance to put it right — except where the breach is serious enough that waiting would cause harm.
On closure we will keep your data available for a reasonable period so you can retrieve it, then delete it in line with the retention rules in the privacy policy. Financial and audit records are retained where the law requires it.
We work to keep Actualogic running and to warn you before planned maintenance, but we do not promise uninterrupted service unless we have separately agreed a service level with you in writing. The service depends on third parties — hosting, networks, app stores — whose failures are outside our control.
Actualogic is a record-keeping and coordination tool. It supports your decisions; it does not make them. You remain responsible for your own compliance, employment practices and accounting.
To the extent the law allows, our total liability arising from these terms is limited to the fees you paid us in the twelve months before the claim, and we are not liable for indirect losses such as lost profit or lost business opportunity. Nothing here limits liability that cannot lawfully be limited.
We may update these terms as the product changes. Material changes will be notified to account administrators by email, and the date at the top of this page will change. Continuing to use the service after that means you accept the updated terms.
These terms are governed by the law of the Republic of South Africa, and disputes fall to the South African courts.
